This Terms and Conditions agreement (hereinafter referred to as the "Agreement") sets forth the rules governing the use of the website https://profcourse.com/ (hereinafter referred to as the "Site") by an internet user (hereinafter referred to as the "User") and FORTERIUM LTD. Collectively, the User and FORTERIUM LTD shall be referred to as the "Parties," and individually as a "Party." The Site is operated by FORTERIUM LTD, a company registered in the United Kingdom at INTERNATIONAL HOUSE 38, THISTLE STREET, EDINBURGH, UNITED KINGDOM, EH2 1EN, under registration number SC877592.
By registering on the Site and using its services, the User agrees to comply with this Agreement.
1. Definitions
1.1. Agreement – a legally binding document that outlines the terms, conditions, and guidelines for using the Site, establishing the relationship between FORTERIUM LTD and the User. The Agreement is a public offer directed at the User by FORTERIUM LTD and regulates access to the Site, its content, suspension or termination of access, liability, and other interactions.
1.2. User – an individual with legal capacity who has accepted the terms of this Agreement in their own interest.
1.3. Registration – the voluntary completion of a form by the User at https://profcourse.com/my-account/, allowing access to services without any registration fee.
1.4. Site Usage – actions performed by the User on the Site, including searching for and accessing information such as videos, articles, and other materials available for purchase.
1.5. Content – any textual, graphical, or audiovisual information available on the Site, whether protected as intellectual property or not, owned by FORTERIUM LTD or third parties.
1.6. Site – a collection of interconnected web pages hosted online under the domain profcourse.com/, with the main page located at https://profcourse.com/.
1.7. Personal Account – a user-specific section of the Site that enables convenient interaction with the services after registration.
1.8. Feedback – responses provided by FORTERIUM LTD to User inquiries via email from [email protected].
1.9. Instructor - any individual engaged by the Company to deliver or support course content on the Platform. Instructors may be employees or third-party providers, and any support provided is at the Company’s discretion.
2. Modifications
2.1. FORTERIUM LTD reserves the right to amend, update, or revise this Agreement at any time. The most current version will be published at https://profcourse.com/terms-conditions/. Users are responsible for reviewing the Agreement periodically. Continued use of the Site after any updates constitutes acceptance of the revised Agreement. If the User does not agree to the changes, they must discontinue use of the Site.
2.2. FORTERIUM LTD may modify, suspend, or discontinue any aspect of the Site or its content at any time without prior notice and without liability to the User.
2.3. Where required by applicable law or where changes are considered material at the Company’s discretion, FORTERIUM LTD may provide notice of updates through the Site or other appropriate means. Unless otherwise specified, updates take effect upon publication.
3. Account Registration
3.1. Users must create a personal account to access most Site features. They are responsible for safeguarding their credentials and must notify [email protected] immediately if unauthorized access is suspected.
3.2. Users must provide accurate and complete information when registering. They are accountable for all activity conducted under their account, including purchases, interactions with other Users, and compliance with this Agreement.
3.3. Sharing login credentials is prohibited. FORTERIUM LTD reserves the right to verify ownership before granting account access.

3.5. Users may close their accounts at any time. Upon closure, access to purchased materials may be permanently revoked.
4. Access to Content

Upon successful registration and purchase, the User is granted the right to access and view the selected courses, materials, and other digital content provided on the Site. Access is limited to personal, non-commercial use and may not be transferred, shared, or resold to any third parties.
4.2. Nature of License
The User receives a limited, non-exclusive, non-transferable, and revocable license to use the purchased or freely available materials solely for educational purposes. 4.3. Users may not copy, distribute, modify, or commercially exploit the materials without prior written consent from FORTERIUM LTD.
5. Delivery of Digital Content
5.1. After completing a successful purchase, the User will gain access to the purchased digital materials through their Personal Account. The materials can be accessed via the "Downloads" section of the User's account.
5.2. Most digital content is delivered instantly upon successful payment. In some cases, access may be slightly delayed due to processing time or technical issues.
6. Pricing, Payment, and Refunds
6.1 Pricing. All prices listed on the Site are indicated in EUR, USD, or GBP as specified and include VAT where applicable. Prices are subject to change at any time without prior notice.
6.2 Payment Methods. Payments can be made using valid credit/debit cards, electronic payment systems, or other payment methods displayed at checkout. Users are responsible for ensuring that payment details are accurate and up to date.
6.3 Refund Policy. Refunds are considered on a case-by-case basis. Access to purchased digital content is granted immediately upon completion of payment, and the Service is considered delivered once content has been accessed. Refunds will only be issued if:

7. User Conduct and Responsibilities

7.4. Enforcement and Penalties
- Remove any content violating these terms.
- Suspend or terminate accounts of users who repeatedly violate the agreement.
- Take legal action against Users engaged in illegal or harmful activities.
8. Liability and Indemnification
8.1. Limitation of Liability
FORTERIUM LTD provides the Site and Services “as is” and “as available” without warranties of any kind. To the maximum extent permitted by law, FORTERIUM LTD shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, business, or reputation.
This limitation does not exclude liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under applicable law, including statutory consumer rights.
8.2. Indemnification
- User violations of this Agreement.
- User actions that harm FORTERIUM LTD, other Users, or third parties.
- Unauthorized use of content, services, or intellectual property.
8.3. Service Interruptions and Force Majeure
- Technical failures beyond its control.
- Force majeure events such as natural disasters, governmental actions, or cyberattacks.
- Maintenance or updates required to improve the Site.
9. profcourse.com Rights
9.1. Ownership of Platform and Content
All rights, title, and interest in and to the profcourse.com platform and its services, including the website, applications, databases, trademarks, code, and content created by employees or partners of profcourse.com, are and remain the exclusive property of FORTERIUM LTD. Users acknowledge that their use of the Site grants no ownership rights over any part of the platform or its content.
9.2. Restrictions on Use
- Modify, copy, distribute, reproduce, or create derivative works from any part of the Site without prior written consent from profcourse.com.
- Use the Site’s content, branding, or proprietary features for commercial purposes without authorization.
- Interfere with or attempt to bypass security measures, digital rights management, or access controls implemented on the platform.
9.3. Right to Modify and Terminate Services
- Modify, suspend, or discontinue any part of the platform at its discretion, with or without notice.
- Restrict access to services, accounts, or content if a User violates the Terms and Conditions.
- Remove content that violates legal regulations, infringes intellectual property, or is found to be misleading or harmful.
9.4. Feedback and Suggestions
Any feedback, ideas, or suggestions submitted by Users to profcourse.com regarding improvements to the platform shall become the property of profcourse.com without compensation to the User. profcourse.com may use such feedback at its discretion.
10. Other Legal Terms
10.1. Binding Effect and Enforceability
By using the Site, the User acknowledges that they are legally bound by this Agreement. If any provision is deemed invalid, the remaining terms will still apply.
10.2. Waiver of Rights
Failure by FORTERIUM LTD to enforce any provision does not constitute a waiver of its rights.
10.3. Governing Law and Jurisdiction
This Agreement is governed by the laws of the United Kingdom. Any legal claims or disputes will be resolved under UK jurisdiction.
10.4. Intellectual Property Rights
All content, branding, and technology on the Site belong to FORTERIUM LTD or its licensors. Unauthorized reproduction, distribution, or modification of Site content is prohibited.
11. Dispute Resolution
11.1. Informal Resolution
Before initiating any formal proceedings, Users are encouraged to contact [email protected] to attempt informal resolution of any disputes. If no resolution is reached within 60 days, Users may pursue other remedies as set out below.
11.2. Arbitration
Where permitted by law, Users may agree to resolve disputes through arbitration administered in the United Kingdom under recognized arbitration rules. Arbitration is voluntary and cannot limit the statutory rights of consumers.
11.3. Court Rights and Consumer Protection
Nothing in this Agreement prevents Users from bringing claims in court where required by law or where mandatory consumer protection rights apply. Users retain all rights under applicable UK/EU consumer protection legislation, including the right to seek redress in court for matters that cannot legally be resolved via arbitration.
11.4. Class Actions and Collective Proceedings
Users may be asked to waive participation in class or collective proceedings in arbitration; however, this does not affect statutory rights that cannot be waived. For UK/EU consumers, the class action waiver is only enforceable to the extent permitted by law.
